People should try to stay in India only for the time they are permitted and be aware of what would happen if they overstay. There are also possibilities that one can extend their trip if their situation calls for it. This has to be done well in advance to avoid the consequences.

Overstaying after visa expiry

It is considered to be illegal for the visa holders if they overstay on their Indian Visa. It is always mentioned in the travel authorizations for all the foreign nationals about the specific time that they can stay in India. The time limit is deepened on the purpose of the visit and the type of visa that is issued to them. The validity for a tourist visa in 180 days, and business or work visa is also 180 days. If you are on a medical visa, the validity is for 60 days.

If a person is caught overstaying the specified time in their visa document, their stay will be considered illegal. This will start from the very day the Visa expires. In such a case, the visa holder will have to beat the legal or financial penalty. The people will have to pay fine to compensate for breaking the immigration rule. The money charges will differ, and it will keep on increasing depending on the period and length of the Visa that has been breached. The immigration department has tightened the laws of immigration, and this has caused the fines to increase.

Legal Penalties when overstaying

The visa holders that have expired visas will have to pay the fine, along with that they also have to be charged with legal penalties. The government of India can take legal action against the Indian E Visa holders if they overstay. If they overstay in India for a short term, then the government and authority don’t likely take full legal action. However, if one commits fraudulent activities or crimes in India, they will be banned from traveling to India for a fixed period or life. In some extreme cases, Indian law and authority can even allow prison sentences for up to 5 years.
